An article written by Yuliya Chernykh and Anastasiya Grenyuk “The Saga of Roehren- und Pumpenwerk Bauer GmbH” has been published in the 2015 edition of the Austrian Yearbook on International Arbitration.
The article analyses the procedure for enforcement of foreign arbitral awards in Ukraine on the example of enforcement by Roehren- und Pumpenwerk Bauer GmbH of an arbitral award of the Vienna International Arbitral Centre. In particular, the article considers the implications of the law reform of 2005, which transferred the responsibility for consideration of applications for recognition and enforcement from the appellate courts to the courts of first instance. The article also analyses the interpretation by the Ukrainian courts of the notion of proper notice as a ground for refusal of recognition and enforcement under the New York Convention.
